Short-Term Rental Agreement
THE PREMISES. The Host agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host:

Hereinafter known as the “Premises.”
LEASE TERM. The Guest shall be allowed to occupy the Premises starting on their check-in date at 4pm and ending on the checkout date at 11am. (“Lease Term”).
QUIET HOURS. Quiet hours begin at 10:00 PM each night and continue until sunrise. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents.
OCCUPANTS. The total number of individuals staying on the Premises during the Lease Term shall be a total of {{number_of_guests}} guests. If more than the authorized number of guests listed above are found on the Premises, this Agreement will be subject to termination by the Host.
BOOKING FEES. The Guest shall pay the Host the amount as detailed during the booking process.
EXCESSIVE MESSES. As part of our commitment to maintaining a clean and pleasant environment for all guests, any mess requiring cleaning beyond normal use will be subject to additional charges. These excessive messes encompass a range of situations, such as but not limited to the presence of excessive trash, bodily fluids, pet-related messes, or persistent unpleasant odors. Our housekeeping team will photo document such instances to accurately assess the extent of the cleaning required.
We understand that accidents can happen, and in such cases, we appreciate guests promptly notifying the staff, so we can respond promptly. However, intentional or reckless acts resulting in excessive messes may result in more substantial charges in proportion to the extent of the damage.
DAMAGE POLICY. In the event of any damages to the motel property caused by a guest or any member of their party during their stay, the motel reserves the right to assess the extent of the damage through a licensed contractor's evaluation. The cost of repairs or replacement shall be charged directly to the credit card provided by the guest during the reservation process. Guests will be promptly notified of any charges and provided with the necessary documentation from the licensed contractor to ensure transparency and fair assessment.
Additionally, in the case of stolen items from the motel premises, the guest will be held responsible for the full cost of replacement. For vintage items or valuables where exact replacement costs are difficult to determine, the charges will be estimated based on a valuation provided by a reputable third party to ensure a fair and accurate assessment.
SMOKING POLICY. Smoking of any kind is strictly prohibited in and infront of guest rooms, on the patio, or by the pool area. Smoking is only permitted in the designated smoking area located at the front of the building. Any violation of this policy will result in additional charges ($50 for outdoor violations and $100 for indoor violations) and could lead to further actions as deemed necessary.
QUIET ENJOYMENT. The Guest, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Guest is expected to behave in a civilized manner and shall be good neighbors with other guests and any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement without refund.

SUBLETTING. The guest does not have the right to sublet the Premises.
INSPECTION. The Host has the right to inspect the Premises with prior notice as in accordance with State law. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this agreement.
UTILITIES. The Host shall be responsible for all utilities and services to the Premises EXCEPT for the following: None.
MAINTENANCE AND REPAIRS. The Guest shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from any Security Deposit prior to a refund if Guest causes damage to the Premises or its furnishings.
HOST’S LIABILITY. The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance for their guests if such coverage is desired.
ATTORNEY’S FEES. The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement.
USE OF PREMISES. The Guest shall use the Premises for residential use only. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.
ILLEGAL ACTIVITY. The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund of pre-paid Rent.
POSSESSIONS. Any personal items or possessions that are left on the Premises are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest. If claims are not made within the State’s required time period or two (2) weeks, whichever is shorter, the Host shall be able to keep such items to sell or for personal use.
GOVERNING LAW. This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location.
PET POLICY
1. All pets and Service Animals must be declared and paid for with the reservation. This is very important because it provides our staff with key information about the occupants of each room.
2. Pets should not be left alone in a room or automobile. An unattended pet is grounds for termination of your reservation without a refund.
3. Pets must be on a leash and attended to at all times.
4. Please clean up after your pet
5. Limit of 1 dog over 40 lbs per room or 2 dogs under 40lbs
6. Pets are not allowed in the pool area for the safety and comfort of all guests.
7. Animals that pose a health or safety risk may not remain onsite and include those that, in our managers' discretion, are too numerous for any one room, cause damage to our property or that of other guests, are too disruptive, are not properly attended, or demonstrate undue aggression.
8. Animals that assist the disabled, known as "Service Animals," are always welcome. Like pets, however, any Service Animal that poses a health or safety risk may not remain onsite.
If you fail to comply with the above and your unattended pet prevents our staff from servicing your room, you may be asked to vacate the property.
POOL POLICY
By using Motel Bear Lake's swimming pool, all users acknowledge and accept the terms outlined in this pool policy. The motel owner shall not be held responsible for any accidents, injuries, damages, or incidents that occur as a result of using the pool. It is the responsibility of pool users to exercise caution, adhere to safety rules, and supervise minors to ensure a safe and enjoyable experience.
1. Supervision of Pool Area:
1.1. The motel owner shall not be responsible for the direct supervision of the pool area. Users are advised to use the pool at their own discretion and risk.
1.2. Parents or guardians are solely responsible for the supervision and safety of their children while using the pool.
2. Swimming Skills and Safety:
2.1. It is the responsibility of pool users to ensure they possess adequate swimming skills to safely use the pool.
2.2. The motel owner is not liable for any accidents, injuries, or drowning incidents that occur due to lack of swimming skills, negligence, or failure to follow pool safety rules.
3. Health and Hygiene:
3.1. Pool users are required to adhere to proper hygiene practices, including showering before entering the pool and refraining from using the pool while experiencing illness or infections.
3.2. The motel owner is not responsible for any health-related issues arising from the use of the pool.
4. Supervision of Minors:
4.1. Parents or guardians are responsible for ensuring that minors under their care are adequately supervised at all times.
4.2. The motel owner shall not be held accountable for any accidents, injuries, or mishaps involving unsupervised minors.
5. Prohibited Activities:
5.1. Pool users are prohibited from engaging in any dangerous or reckless behavior, such as running, diving in shallow areas, or horseplay.
5.2. The motel owner shall not be responsible for any injuries resulting from prohibited activities.
5.3. No glassware, alcohol consumption, smoking or drug-use of any kind allowed in the pool or pool area.
5.4. Pets are not allowed in the pool area for the safety and comfort of all guests.
6. Use of Pool Facilities:
6.1. The motel owner is not responsible for the availability or functioning of pool facilities
6.2. Any damage caused to pool facilities by users shall be the responsibility of the respective users.
7. Personal Belongings:
7.1. The motel owner is not liable for any loss, theft, or damage to personal belongings left unattended in the pool area or its vicinity.
7.2. Users are encouraged to secure their belongings and valuables appropriately.
8. Hours - Guest must comply with posted open hours.
